Submitting an Oil Spill Claim to BP

On April 20, 2010, British Petroleum's (BP's) Deepwater Horizon oil rig exploded, resulting in the worst oil spill in US history. This spill continues to cause billions of dollars of damage to wildlife, the economy of the Gulf of Mexico and private property in the area.

Those who believe they should be reimbursed by BP need to file a claim with the company. Currently, claims can be filed for bodily injury or illness, property damage or loss of income. Claimants may start the process by visiting BP's website to fill out an initial claim form. They must describe the injury, illness or property damage they have been subject to because of the gulf oil spill, as well as explain any loss of income experienced.

If filing multiple claims, BP has set forth the following guidelines:

  1. If filing for loss of income, file separate claims for each person.
  2. Those who have suffered property damage to a vehicle, boat or water vessel need to include all items on one claim per person. Claimants must make sure the property they are claiming is in their name. If it is not in their name, a separate form needs to be filled out for the actual property owner.
  3. If property damage is being claimed on a real estate property, a separate claim needs to be filed for each address, even if the properties are in the same person's name.

Once the online claim form is completed, each claim will be given a processing number, which will be provided to claimants via email or telephone call. After a claim number is provided, a BP representative will contact the injured party or their attorney to verify their identity and request any additional documentation. In some instances, a field visit may be conducted to verify the claim. For those submitting a claim for loss of income due to the BP oil spill, an advance payment may be made by BP up to one month's salary before the entire claim is paid out.

While an attorney is not necessary to file a claim with BP, it is suggested to do so in many cases, especially for those submitting a multiple amount of claims or single claims for large sums of money. However, submitting a claim through BP is free of charge, and the company is ensuring that all claims will be processed in a timely manner.
